Существующая сегодня проблема конкуренции правовых норм, регулирующих смежные объекты, создает значительные затруднения у непосредственных правоприменителей, влечет нарушения единообразия практики применения законодательства, что, в свою очередь, приводит к нарушению принципа справедливости, установленного ст.6 УК РФ.

Примером подобной конкуренции могут служить однородные предметы регулирования нормы уголовной ответственности, установленной п.«б» ч. 3 ст. 158 УК РФ – кража из трубопровода, нефтепровода, нефтепродуктопровода, и нормы административной ответственности, установленной ст.7.19 КоАП РФ – самовольное подключение к электрическим сетям, тепловым сетям, нефтепроводам, нефтепродуктопроводам и газопроводам, а равно самовольное (безучетное) использование электрической, тепловой энергии, нефти, газа или нефтепродуктов.

Первой проблемой является отсутствие законодательно-установленного порога, отделяющего уголовную ответственность от административной. С одной стороны, формально уголовная ответственность за хищения наступает при установленном размере ущерба более 2500 рублей2.Однако данное правило касается, прежде всего, «простого хищения», т.е.ч. 1 ст.158 УК РФ.Квалифицированные формы тайного хищения, предусмотренные ч.2-4 ст.158 УК РФ, предусматривают наступление уголовной ответственности не зависимо от размера похищенного.При этом объективная сторона состава преступления, предусмотренного п.«б» ч.3 ст.158 УК РФ полностью дублирует объективную сторону административного преступления, предусмотренного ст. 7.19 КоАП РФ в части подключения и безучётного потребления из газопровода.Потребление – это по сути своей одна из разновидностей хищения в форме растраты3.Таким образом, можно сделать вывод, что потребление искомого ресурса из газопровода представляет из себя хищение, то есть деяние, за которое установлена уголовная ответственность в соответствии с п. «б» ч. 3 ст. 158 УК РФ.В таком случае возникает закономерный вопрос о целесообразности наличия в КоАП РФ нормы, устанавливающей административную ответственность за деяние, уже подпадающее под область правового регулирования особенной части УК РФ, не зависимо от размера причиненного ущерба.При этом содержащаяся в КоАП РФ оговорка «если эти действия не содержат уголовно-наказуемого деяния» однозначно определяет приоритет норм уголовного права над административным законодательством.

Доводы о том, что ст. 7.19 КоАП РФ предусматривает ответственность в том числе за незаконное подключение, на наш взгляд, выглядят несостоятельными, т.к.сами действия по подключению, связанные с техническим повреждением тела трубопровода, не являются самоцелью.Мотивом данного противоправного поведения является именно получение доступа к искомому предмету хищения – газу, с целью его дальнейшего потребления, то есть субъективная направленность деяния имеет ярко выраженные признаки хищения.

При этом самовольный характер действий по подключению, отраженный в ст. 7.19 КоАП РФ, сам по себе подразумевает тайность и безвозмездность.

Можно допустить ситуацию, когда действия по самовольному подключению к трубопроводу с целью дальнейшего потребления были пресечены до момента достижения субъектом своего противоправного результата.Однако данная ситуация исключает возможность применения ст. 7.19 КоАП РФ, т.к.указанная норма предусматривает административную ответственность именно за комплексное деяние, состоящее из подключения и использования (потребления).Также в связи с указанной нами выше субъективной направленностью, указанные действия можно считать в качестве пресеченного покушения на хищение, и должны квалифицироваться в порядке, предусмотренном ч.3 ст. 30 УК РФ.

А.А.Желдакова предлагает решение указанной проблемы путем изменения диспозиции нормы ст.7.19 КоАП РФ, установив ответственность за подключение к соответствующим объектам трубопровода без цели хищения4.Мы с данной позицией не согласны, ввиду того, что, как нами было отмечено выше, единственным мотивом данных действий является именно получение доступа к искомому ресурсу с целью его хищения.Поэтому любые действия, связанные в незаконным подключением к газопроводу с целью дальнейшего хищения путем потребления, не зависимо от стадии совершения преступления, следует квалифицировать по п.«б» ч. 3 ст. 158 УК РФ5.Эта позиция обусловлена прежде всего тем, что данное преступление представляет повышенную опасность, обусловленную самим способом его совершения, связанным с механическим повреждением тела трубы, что, в свою очередь, порождает опасность повреждения трубопровода, утечки и самовозгорания опасных веществ, проходящих по трубопроводу.Этим объясняется логика Законодателя, отнесшего данное деяние к категории тяжких преступлений6.

Мы согласны с тем, что в связи с преобладанием уголовного права над административным изменениям должна быть подвергнута норма ст.7.19 КоАП РФ.Убедившись, что область правового регулирования п. «б» ч. 3 ст. 158 УК РФ в полной мере обеспечивает правовую охрану общественных отношений в сфере транспортировки энергетических ресурсов посредством газопровода, нефтепровода и нефтепродуктопровода, мы приходим к выводу о необходимости полного исключения указанных понятий из диспозиции ст. 7.19 КоАП РФ.Таким образом, с целью исключения возможности конкуренции нормы УК РФ и КоАП РФ мы предлагаем изложить диспозицию ст. 7.19 КоАП РФ в следующей редакции: «самовольное подключение к электрическим сетям, тепловым сетям, и самовольное (безучетное) использование электрической и тепловой энергии». Таким образом, исключив из диспозиции предмет посягательства, покушение на который уже урегулировано нормой уголовного права, удастся нивелировать возможность конкуренции данных норм.

The article deals with the problems of distinguishing the crime provided for in paragraph "b" of Part 3 of Article 158 of the Criminal Code of the Russian Federation from the administrative offense provided for in Article 7.19 of the Administrative Code of the Russian Federation when qualifying the theft of gas from a gas pipeline in an amount that is not significant. Due to the coincidence of objective and subjective signs, the author proposes to exclude gas as an object of theft from the disposition of Article 7.19 of the Administrative Code of the Russian Federation.
