Ваши критерии качества научной статьи? Критериями качества научной статьи, на мой взгляд, являются, наряду с ее актуальностью и научной новизной, широкая научная база, содержащая анализ точек зрения и позиций других ученых, исследовавших ранее данную проблему, а также достоверность и обоснованность аргументов собственной оригинальной позиции.Ну и, безусловно, практическая значимость излагаемых выводов для правовой теории, законодателя либо правоприменителей.Мой научный руководитель по кандидатской диссертации, профессор Гришанин Петр Феоктистович, всегда говорил, что правильная аргументация зачастую гораздо важнее самих научных выводов.

Критерии качества статьи, в основном, определяются ее новизной, оригинальностью, наличием собственной эмпирической базы, глубиной теоретической разработки проблемы, самостоятельностью выводов.Мой научный руководитель, доктор юридических наук, профессор Леонид Васильевич Багрий-Шахматов (к сожалению, ушедший из жизни), учил, что в статье должна быть поставлена теоретическая или практическая проблема и предложены пути ее решения, этому совету я стараюсь следовать до настоящего времени.Еще он советовал мне не выбрасывать результаты проведенных исследований и те статьи, которые не удалось опубликовать - через много лет, когда молодой задор уйдет, они  пригодятся.
В этом совете тоже есть рациональное зерно, но у меня все ранние статьи опубликованы, "задор", к счастью, не ушел, поэтому современные статьи я строю на современных исследованиях.

Ваши критерии качества научной статьи? 1.Актуальность вопросов, рассматриваемых в статье.Статья актуальна, если содержит авторское видение новелл законодательства либо решение новой проблемы (теоретической правотворческой, правоприменительной).Статья также может быть актуальной, если ее тема не нова, но дискуссионна.
2.Оригинальность ответов на поставленные вопросы, их отличие от решений, предложенных другими специалистами.
3.Наличие ссылок на теоретические источники (нормативные правовые акты – не в счет).Сознательное отступление от этого правила является серьезным нарушением этических норм.Все мы так или иначе стоим на плечах своих предшественников, нас окружают коллеги, занимающиеся научной деятельностью, возможности доступа к научной информации сейчас широки, как никогда – вот обстоятельства, в силу которых претендовать на роль «первооткрывателя» в наше время просто некрасиво.Недопустимо игнорирование трудов коллег по причинам, не имеющим отношения к науке (молодой возраст ученого, незначительность его вклада в науку, место его работы, личная неприязнь и т.п.).
4.Отсутствие в статье плагиата, т.е.фрагментов чужого текста без оформления цитат и ссылок на источники.

Критерии качества научной статьи ? Как написать научную статью? К сожалению этому нигде не учат.Приходится  работать над статьей интуитивно.Прежде всего статья должна выполнять научную, теоретическую, практическую функцию.Нередко к нам в областной суд приходят ученые Уральского юридического университета, принимают участие в «круглых столах» по тем или иным проблемам правоприменения, изучают и обобщают судебную практику.Выясняют проблемы, которые требуют разрешения.Например, 11 апреля 2014 года в Свердловском областном суде был проведен круглый стол, посвященный вопросам, возникающим в практике применения норм главы 47.1 УПК РФ, регулирующих производство в суде кассационной инстанции.В его работе приняли участие судьи кассационной инстанции и преподаватели кафедры уголовного процесса юридического университета.По итогам обсуждения спорных вопросов правоприменения был издан сборник вопросов и ответов: актуальные вопросы производства в суде кассационной инстанции.
Это своего рода фундамент для дальнейшей научной работы по определенным направлениям: субъект и предмет обжалования.Например, в ходе круглого стола предметом обсуждения был вопрос: соответствует ли Конституции РФ и международным правовым актам установление в УПК РФ пресекательного срока на обжалование судебного решения в кассационном порядке.
Областной суд заранее сформулировал спорные вопросы по данной теме.Каждый из вопросов может быть использован для подготовки научной статьи.Не требуется ничего придумывать, брать темы для исследования, по которым нет никаких споров.Статья должна выполнять научную, теоретическую и практическую функцию.Это всегда предполагает анализ судебной практики по исследуемой проблеме.
Анализ может представлять заключение по какому-то вопросу, поиск негативных моментов, выступление с предложениями и «обобщение», то есть создание какого-то общего (теоретического правила, информирование о тех или иных правовых положениях, подготовка соответствующих правовых позиций.Это тот фундамент, от которого зависит качество статьи.Именно наука создает ту основу, на которой строится законодательство, но не следует игнорировать и судебную практику.  При подготовки статьи авторы как раз должны исходить из этого положения.Поэтому работу над статьей необходимо строить таким образом, чтобы каждый материал  должен содержать так называемое общее правило, а на его основе – обобщение сложившейся судебной практики.
Да суд применяет законодательство, однако в случае неадекватного расхождения между теорией и практикой можно обратиться с соответствующими предложениями.В итоге  статья может содержать следующую информацию: краткое содержание вопроса, существо правоотношения, почему возник этот вопрос и как он проявляется на практике и с точки зрения в доктрине ( отрасли права и смежных системах, отраслях).Далее должны следовать теоретические предложения на основе проведенного анализа.Таким образом, автор, являющийся специалистом в конкретной области знаний (отрасли права) обеспечивает подготовку текста документа, его наполнение соответствующими позициями ученых, практиков, мнениями доктрины.Научный руководитель осуществляет правку данного материала и получается востребованный материал.
