Проектом Федерального закона «О внесении изменений в Уголовный кодекс Российской Федерации и Уголовно-процессуальный кодекс Российской Федерации по вопросам совершенствования оснований и порядка освобождения от уголовной ответственности» предлагается дополнить действующий институт освобождения от уголовной ответственности новым основанием, которое должно быть закреплено в ст. 762 УК РФ «Освобождение от уголовной ответственности в связи с применением иных мер уголовно-правового характера» в следующей редакции:

«Лицо, впервые совершившее преступление небольшой или средней тяжести, может быть освобождено от уголовной ответственности и подвергнуто мерам уголовно-правового характера, указанным в статье 104.4 настоящего Кодекса, в случае если им возмещен ущерб или иным образом заглажен причиненный преступлением вред».

Судебная практика свидетельствует, что при более четкой правовой регламентации отдельных положений освобождения от уголовной ответственности немалая часть уголовных дел могла бы прекращаться при досудебном производстве.Кроме того, повышению эффективности института освобождения от уголовной ответственности может способствовать расширение диапазона возможностей судебно-следственных органов по освобождению от уголовной ответственности за преступления небольшой и средней тяжести.

В этих целях в проекте предлагается конкретизировать действия правоприменителя при досудебном производстве по уголовному делу, по которому допустимо примирение сторон, а также ввести новое основание освобождения от уголовной ответственности – в связи с применением иных мер уголовно-правового характера.

В качестве иных мер уголовно-правового характера предлагается применять некоторые виды наказаний, не связанных с изоляцией осужденного от общества, а именно: штраф, лишение права занимать определенные должности или заниматься определенной деятельностью, обязательные работы и исправительные работы2.

Полагаем, что предпосылкой нормативного закрепления исследуемого основания освобождения от уголовной ответственности явился политический курс государства, направленный на извлечение финансовой выгоды из всех доступных сфер жизнедеятельности общества в период международных экономических обострений.

Следует отметить, что проект ст.762 УК РФ вызвал споры среди теоретиков и правоприменителей, большинство из которых сразу выделило ряд логических проблем, вопросов соответствия Конституции РФ.

Так, среди всех оснований освобождения от уголовной ответственности в ст. 762 УК РФ реализуются основные цели наказания.Проводя сравнительный анализ основания освобождения от уголовной ответственности в связи с применением иных мер уголовно-правового характера и иных оснований, позволяющих освобождать лицо от уголовной ответственности и наказания, следует отметить, что их также можно классифицировать по степени реализации целей наказания.

Следующим проблемным вопросом регламентации исследуемого основания является правовая природа мер уголовно-правового характера. Из содержания проекта ст.

1044 УК РФ следует, что иными мерами уголовно-правового характера являются виды наказаний, указанные в пп. «а», «б», «г», «д» ст.44 УК РФ.Тем самым автор законопроекта присвоил видам наказаний абсолютно не свойственную для них функцию, не связанную с наказанием, что является явным противоречием.Тем более, что такая ситуация неизбежно приведет к нарушению конституционных прав и свобод человека.За схожие преступления в разных регионах правоприменитель может, в одном случае не освобождать лицо от ответственности и применить к нему наказание, например, в виде штрафа, в другом освободить от уголовной ответственности с применением так же штрафа, как иной меры уголовно-правового характера.При этом в первой ситуации у лица имеется судимость, а во второй нет.

Представляется, что и в проекте новое основание закреплено в ст.762  УК РФ не верно.По наиболее родственному основанию, исследуемая норма должна располагаться после ст.75 УК РФ, так как является специальной по отношению к деятельному раскаянию.

В связи с этим, следует предположить, что процесс развития уголовного законодательства не всегда отвечает потребностям правоприменительной деятельности, достижению целей уголовного закона.Практически каждый сотый осужденный в России человек был освобожден от уголовной ответственности за совершенное преступление.Увеличение числа таких лиц связано с периодами либерализации уголовного законодательства и практики его применения, в том числе с изданием актов об амнистии.Большая часть данных лиц вновь совершили корыстные преступления против собственности.За время действия УК РФ в среднем более половины лиц, ранее освобождавшихся от уголовной ответственности было осуждено за вновь совершенные ими преступления, причем тяжкие или особо тяжкие.Применение оснований освобождения от уголовной ответственности проявляет себя в фальсификации уровня уголовно-правового рецидива путем неучитывания умышленных преступлений, в связи с которыми виновные лица освобождались от уголовной ответственности, при совершении ими новых умышленных преступлений.Получается, что фактически повторное преступное поведение наличествует, в то время как юридически его нет.По сути, предшествующее освобождение от уголовной ответственности является обстоятельством, способствующим недопущению ужесточения наказания за совершение нового преступления3.

Учитывая изложенное, следует согласиться с профессором Сверчковым В.В.и задать законодателю ряд вопросов.Например, почему лица вновь совершают преступления после освобождения их от уголовной ответственности? Действительно ли их освобождение от уголовной ответственности направлено на решение задач уголовного законодательства? Насколько справедливым и обоснованным является такое освобождение?

Представляется, что такое количество не разрешенных вопросов позволяет сделать вывод, что проект нового основания освобождения является необдуманным и преждевременным.

К тому же, полагаем, что под сомнение следует поставить существование института освобождения от уголовной ответственности в целом.Его трансформация в институт освобождения от наказания позволила бы снять имеющиеся спорные вопросы в правоприменительной деятельности, а процедуру освобождения лица поручить более компетентному органу – суду.
